City of San Marcos & California Regulations
On October 26, 2021, in an effort to reduce litter and landfill waste in San Marcos, the City Council adopted Ordinance № 2021-1507 pertaining to the distribution, sale, and use of single use plastic food service ware and other plastic products as specified. Generally, the ordinance requires that all disposable single-use food ware products be either recyclable or compostable, and that some be made of a non-plastic material.
On October 5, 2021, Governor Gavin Newsom signed into law Assembly Bill (AB) 1276 – Single-Use Foodware Accessories and Standard Condiments. In San Marcos this means that beginning June 1, 2022, the City will enforce the State requirements that Food Service Providers only provide Disposable Food Service Ware Accessory products upon request with some conditions and exceptions.
These requirements will go into effect in three phases, with the first phase coming into effect on June 1, 2022. Phase two begins on July 1, 2023 and phase three begins on January 1, 2024.
