There are many factors to consider when opening a new business, especially when selecting a location, whether it's constructing a new building, remodeling a building or tenant space, or taking over an existing business “as is,” each has unique permitting and licensing requirements that should be considered before signing a lease or entering into a purchasing agreement.
To assist businesses in the site selection process, the City of San Marcos utilizes a web-based tool designed to help businesses identify suitable locations, based on compliance with zoning regulations. By entering the type of business and answering some questions about the proposed business location, the tool will provide feedback on the anticipated compliance with zoning regulations and allow you to explore the City’s zoning map, to determine potential zoning permitting requirements for alternative locations.
To access the tool, select “The Zoning Portal” from the buttons below. Additionally, other resources for businesses are available using the buttons below and include “Steps to Starting a New Business” and learn “More about Licensing.” The “Steps to Starting Business” provides a comprehensive guide designed to walk entrepreneurs through the necessary steps of opening a business and “More About Licensing” is the gateway to applying for a City Business License and learning more about other licensing requirements for different types of businesses.
PLEASE NOTE: The Zoning Portal only provides feedback on the anticipated compliance with zoning regulations. Additional zoning regulations, such as requirements for additional parking or other regulations specific to the type of business may be applicable and require additional review by Planning staff (even if the Zoning Portal indicates a business is allowed at a location). In addition to potential compliance with zoning requirements, a Business License is required prior to conducting any business operations at the proposed location. Alterations, tenant improvements and/or changes in building occupancy may require a Building Permit and/or the reissuance of a Certificate of Occupancy by the Building Division. Depending on the type of business, additional permits and/or licenses from the State or County may also be required.
